Michigan Dream Vacation Home Guest Terms and Conditions

These are the terms and conditions for this rental home. Please read them thoroughly, as you are responsible for all information within this document. Receipt of Terms and Conditions (page 1) or acceptance on Michigandreamvacation.com, Homeaway.com, VRBO or any other online listing service; will be considered your agreement to all terms and conditions.

Damage Waiver Fee

We do not charge a security deposit for our properties. In lieu of a security deposit for damages, we charge a flat fee for all damages up to $2,000. If during your stay, damages exceed $2,000; your credit card will be charged the balance of damages above $2,000. This damage waiver excludes damage caused by smoking, pets or criminal activity, as long as you report the damage before checking out. 

Parties or events are not allowed under any circumstance. Evidence of parties or events (bachelor/bachelorette, wedding etc.) will result in additional damages charged to your credit card. We will also report your use of this home for these non-authorized events to any and all online listing service you may have used to secure this rental home.

Check-in

Check-in is 4:00 PM Eastern Time (3:00 PM Central Time), unless you have arranged and paid for an early check-in. Cleaners and owner’s inspector will not allow early entry for any reason and are to inform the owner of any attempt.


Property Entry

You will be provided property directions and the keypad code in your arrival email. That email is usually sent 24-48 hours prior to arrival and will include driving directions and entry instructions.


Our properties are equipped with a Ring video doorbell. Generally, the video doorbell is located on the front door with coverage of the front yard, front walk and front door. All alerts are turned off during your stay and video will only pulled in the event of a security issue. If you need help with anything, please call or text Karen at 708-364-9331. There is NO indoor audio/video surveillance of the property, nor is there any type of artificial intelligence device (Alexa, Google Home, Echo Show, etc.).

Check-out
Checkout by 11:00 AM Eastern Time (10:00 AM Central) unless you have arranged and paid for late checkout. If possible, please complete items on the checkout list. It is a tremendous help to our cleaning crew and will ensure we can get the house cleaned and reset for our next guests.

 All persons and personal items must be removed by 11:00 AM ET (10:00AM CT). Cleaners will enter and begin cleaning at 11 AM (10 AM CT). There is a $100 per hour fee, one-hour minimum, for anytime you are in the property after 11 AM (10 AM CT).

We try to accommodate early check-ins and late checkouts on whenever possible. If you wish to have an early check-in or late checkout please notify Karen prior to your stay. We will attempt to accommodate your request but can not make any guarantees.


Cancellation / Refund Policy

A thirty (30) day notice is required for cancellation, your reservation will be 100% refunded if cancelled more that 30 days prior to arrival. 50% of reservation will be refunded if cancelled 15 - 30 days prior to reservation.

Cancellations within 14 days shall not be entitled to any refund. If you are disappointed or unsatisfied with the house due to different tastes relevant to décor, accommodations, location, construction, lake conditions, etc. and decline to stay at the house, this will be considered a cancellation and no rent reduction or refund will be issued. Vacation Rental insurance, which is not provided by Owner, is recommended.

Reservations

The person or persons under whose name the reservation is booked must be 27 years old. Reservations obtained under false pretense are subject to forfeiture of any and all monies paid, refusal to check-in or immediate eviction upon discovery.

Responsibility

The person or persons under whose name the reservation is booked must reside at the property for the duration of the rental. They are responsible for ensuring that their party and their visitors abide by all the rules set forth in this document, in the reservation confirmation and those posted at the property. Failure to do so will result in eviction without refund.
We are pleased you have chosen to vacation at our home, but please remember you are vacationing in a residential neighborhood. While you may be on vacation, some of our neighbors might not be. Please be respectful of the area you have chosen to stay and remember you are subject to local laws and noise ordinances.

Locked Garages/Closets

Locked closets and locked garages are not included in the rental of the property. Please note, nothing of true value is behind these locked closets or garages. They are mainly cleaning supplies or personal property of the owner. Please don’t try and pick locks. Damage to locked closets or locked garages will result in additional check-out fees.

Cable Television/WIFI

Our properties are equipped with Comcast Cable or Spectrum Cable (Pinecrest) and high speed internet/WIFI. Streaming services, such as Netflix and Amazon, etc, should be billed to your credit card. Any charges to the property owner’s account will incur a $25 fee. Please log in to your streaming service account to ensure no accidental charges. Additional information for TV operation will be available in the property binder.

Furnishings

We have tried to furnish and decorate our home in a comfortable manner and to reflect our love of Michigan. Inside furnishings should not be taken outside. Plates, cups, silverware, bath towels, linens, etc., should not be taken off premises.

Payments

If you made reservations through Homeaway.com or other online platform: Payments will be collected accordance with VRBO.com, or other online platform’s existing procedures. Michigan Dream Vacation utilizes the Stripe Platform for credit card processing. Charges will show up as Gryphon Montana Ventures, LLC in Orland Park, IL. 
Direct bookings will be accepted via credit card or personal check at the previously described payment schedule.

Housekeeping

Your rental property will be furnished with: bed linens (sheets, pillowcases, blankets), bath towels, hand towels and washcloths, kitchen linens (washcloths and towels). We provide enough bath towels, wash cloths and hand towels each member of your party plus a handful of extras. Bedding (sheets, pillowcases, blankets) are provided for each bed and sleeper sofa's in the property. 
A beginner set of consumables (toilet paper, facial tissue, paper towel, hand and dish soaps, coffee filters, garbage bags and where applicable: dishwasher soap, laundry soap and dryer sheets) are also provided. If, during your stay you run out of any of the above mentioned supplies, it will be the guest’s responsibility to procure additional consumable supplies.
Beach towels are not provided at Our Rental Homes. Please remember to bring your own. Linens, bedding and towels are not to be removed from the property for use at the beach or pool, for picnicking or any other use. Use of additional linens and/or towels found at the property may result in additional charges.

Occupancy

Occupancy is the number of people who stay the night and use the amenities during the day.
  • Endless Blue maximum occupancy is ten (10). Please note, this home is located in Casco Township, Michigan. Local ordinance mandates certain max occupancies for this home. Ten (10) people regardless of age may be in this home. You could face civil penalties in addition to additional rental fees if more than max occupancy is at this home.
  • West Winds maximum occupancy is twelve (12). Per our rental permit with Saguatuck Township, that number may not be exceeded.
  • Pinecrest maximum occumpany is six (6).
This is a strict policy and the penalty is immediate eviction without refund. Parties, reunions or large gatherings are not allowed. When in doubt, please ask.

Phones / Cable / Streaming Services

Cable / Streaming services are limited to channels available without additional fees. Violations will be charged a minimum of $50 in administration fees; in additional to any fees, service charges presented from our cable provider.

Pets

Regrettably, pets are not accepted at West Winds or Endless Blue. Evidence of pets will result in additional damage and cleaning fees charged to your credit card.

Dog Policy (Pinecrest Only)

  • Well behaved, well-adjusted dogs are welcome and are limited to 2 dogs. Cats are not allowed due to severe owner allergies. 
  • Reservations including dogs will be charged a $150 pet fee per stay. 
  • All vaccinations and immunizations must be up to date. 
  • This includes flea treatments. Clean up after your dog to ensure the yard is clean for our next guests. 
  • Please do your best to ensure your dog will not bark excessively or roam into neighboring properties. Complaints may lead to eviction without refund and are solely at the discretion of the owner. 
  • Please do your best to keep dogs off of furniture or beds. Extra cleaning fees will be charged for dog hair left behind and can run as much as $250. 
  • A dog bed will be provided but, feel free to bring your dog’s favorite bed or kennel with you. 
  • Please keep your dog crated if you will leave the property for any length of time. 
  • Please don’t leave your dog unattended for long, extended periods of time. Dog owners are responsible for any damages your pet causes.  
  • Do your best to clean up after walks and hikes with your dog. This will help to ensure that no additional cleaning fees are necessary due pet related messes (i.e. muddy paw prints, fur on furniture). A $250 charge will be assessed to your credit card if excessive mess is reported; due to dogs. 

 


Fire Pits and Fireplace

Please use caution while using the propane and or wood fire pits. No fire should be left unattended. Do not leave children unattended while using the fire place or fire pit. Please ensure fire is completely extinguished when done using fire place. No other fire or fire pit location is at this property. PLEASE DO NOT OPERATE THE PROPANE FIRE PIT OR GRILLS ON THE WOODEN DECK AT ANY TIME. Due to local fire ordinance, fire pits and grills must not be on wooden structures (West Winds and Endless Blue).

Smoking

This home is non-smoking. Violators are subject to immediate eviction, forfeiture of all monies and additional cleaning charges, which can be quite substantial. Please smoke outside, only in designated areas. Dispose of your smoking remnants responsibly. Failure to do this will result in additional cleaning charges.

Lost and Found

The owner is not responsible for items left in the property. We make an effort to collect items and hold them for thirty (30) days. If you have forgotten something, contact us to see if it has been found and arrange its return. Guests are responsible for any shipping fees for lost items.

Right of Entry

Property owners and their agents may need to enter the property for the purpose of inspection, repairs or maintenance. We will do our best not to disturb you. Landscapers and other service personnel may need to access the property during your stay. Again, we will do our best not to disturb you; but please be patient with these service providers. They are doing their jobs to maintain our home and they may not be able to schedule all service appointments around our turnover times. We appreciate your understanding.


Tram and Stair Associations (Endless Blue only)

The homeowner is not responsible for nor in charge of Lake Michigan access via the trams, stairs and revetment (rock wall) to Lake Michigan. Access is not guaranteed and may not be accessible due to inclement weather, other Acts of God, mechanical failure or closure due to maintenance and/or repair. Weather, historically high (or low) Lake Michigan water levels and wave action vary daily along Lake Michigan. The homeowner cannot control nor guarantee access or condition of the beach within the limits of Miami Park’s property lines; during any portion of your stay. No refunds will be given for lack of access to the beachfront, high water in Lake Michigan, stairs, tram or revetment closure or lack of useable beach.

  

Both the trams and stairs and their respective properties are under the control of each association’s respective board of directors and bylaws. Guests of Endless Blue (this vacation rental home) are subject to the rules and bylaws of each association. Those rules and bylaws can be reviewed in the property binder on site at Endless Blue. The renter and all renter guests understand they are using the stairs, trams and revetment (rock wall) fully AT THEIR OWN RISK.


Guests and tenants understand that stairway, tram and revetment use for beach access is being provided by landlord/owner through THE NEW MIAMI PARK STAIRS ASSOCIATION and BEACHSIDE TRAM ASSOCIATION, WEST END INCLINE ASSOCATION, THE LAKE VIEW TRAM ASSOCIATION, LAKE MICHIGAN TRAM ASSOCIATION, ALL FOUR TRAMS and LAKESHORE BLUFF ASSOCATION (“Associations”) as a free accommodation to the rental tenant and their guests, and that such use may pose liability and risk. Being aware of such risk and liability, the tenant agrees that use shall be at their sole risk and not that of the respective Associations or owner. Tenant waives and releases any and all claims or potential claims against the Association’s arising from or relating to their use of the stairway or respective trams. Additionally, all respective guest(s) of Tenant waives and releases any and all claims or potential claims against the Associations arising from or relating to their use of the stairway or respective trams.


The renter(s) acknowledge property owners and their agents cannot be held responsible, regardless of fault, for any accident, loss, damage or injury suffered by the renter, members of their party or any other guests which renter or their party have allowed access to the property, regardless of said loss results, directly or indirectly, from acts of God, danger incident to any body of water, fire, breakdown of machinery, equipment, acts of government or other authorities, delays or cancellations of or changes in itineraries or schedule from acts of omission on any airline. Furthermore the renter will release and hold harmless any and all parties involved with the rental, management and reservations of the property and to release and hold harmless it’s owners and representatives for any loss or damage to personal property or for any injury or death.
